SMS/Text Messaging Terms

The Taylor Team at Berkshire Hathaway HomeServices New Mexico Properties ("we," "us," or "our") offers an SMS/text messaging program to provide you with property alerts, market updates, and real estate communication. By opting in to our SMS program, you agree to the following terms and conditions.

Program Description

When you opt in to receive text messages from The Taylor Team, you may receive the following types of messages:

  • Property alerts: Notifications about new listings, price changes, or properties matching your criteria
  • Market updates: Local real estate market data, trends, and neighborhood information
  • Appointment confirmations: Reminders and confirmations for property showings, consultations, and meetings
  • Agent follow-ups: Messages from Katey Taylor, Ashley Duran, or our team regarding your real estate inquiries
  • Transaction updates: Status updates related to active real estate transactions you are involved in

Message Frequency

Message frequency varies based on your activity, preferences, and the status of any real estate transaction. You can typically expect to receive approximately 2 to 8 text messages per month. During active property searches or transactions, message frequency may increase.

Opt-In and Consent

You may opt in to our SMS program through the following methods:

  • Website forms: By providing your phone number and checking the SMS consent checkbox on our contact form, home valuation request, or other lead capture forms on taylormadeabq.com
  • Verbal consent: By providing verbal authorization to one of our agents during a phone call, consultation, or in-person meeting

By opting in, you expressly consent to receive recurring automated marketing and informational text messages from The Taylor Team at the phone number you provide. You understand that consent is not a condition of any purchase or service.

You are not required to consent to receiving SMS messages as a condition of purchasing any property, receiving any real estate services, or engaging The Taylor Team as your real estate agent.

How to Opt Out

You may opt out of our SMS program at any time by replying with any of the following keywords to any message you receive from us:

STOP  ·  UNSUBSCRIBE  ·  CANCEL  ·  END  ·  QUIT

After sending an opt-out keyword, you will receive a single confirmation message confirming that you have been unsubscribed. You will not receive any further messages from our SMS program unless you opt in again.

You may also opt out by contacting us directly at team@taylormadeabq.com or by calling (505) 974-9701 and requesting removal from the SMS program.

Message and Data Rates

Message and data rates may apply. Text messaging charges from your wireless carrier may apply to messages sent to and received from our SMS program. Please contact your wireless carrier for details about your text messaging plan and any applicable charges. We are not responsible for any charges incurred by your wireless carrier.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and compatibility with your device. We cannot guarantee delivery of every message and are not responsible for messages that are not received due to carrier issues, device incompatibility, or other factors outside our control.

Supported Carriers

Our SMS program is supported on all major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Cricket, MetroPCS, Boost Mobile, Virgin Mobile, and others. Carriers are not responsible for the content of messages sent through our program.

Privacy and Data Sharing

Your privacy is important to us. We handle your phone number and SMS data as follows:

  • We do not sell, rent, or share your phone number or SMS opt-in data with third parties for their marketing purposes.
  • Your phone number is shared only with our SMS delivery provider (Telnyx) for the sole purpose of delivering messages you have consented to receive.
  • Your SMS consent and opt-in status are recorded and stored in our database (Supabase) for compliance purposes.

10DLC Compliance

Our SMS program is sent from a 10-digit long code (10DLC) phone number that is registered in compliance with carrier requirements and the Campaign Registry. Our SMS sending number is (505) 494-1599, delivered through Telnyx.

TCPA Compliance

Our SMS messaging program complies with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. Section 227. We obtain express written consent before sending marketing text messages, maintain accurate opt-out records, and promptly honor all opt-out requests.
